Court Rulings May Determine Whether Fingerprint Evidence Is Reliable
Fingerprints are one of the most common forms of evidence used in criminal cases. It has been generally understood for more than a century that everyone’s fingerprint is unique, and the imprints left behind at crime scenes can be used to identify suspects. However, some have begun to call these assumptions into question, and courts may be looking at fingerprint evidence with more scrutiny to determine whether it is as reliable as many people believe.

New Jersey Supreme Court Addresses Fingerprint Evidence
For decades, courts have generally accepted fingerprint evidence as reliable, allowing experts to testify in criminal cases about whether fingerprints can be used to confirm that a defendant was at the scene of a crime. However, based on scientific studies that have been conducted over the past two decades, people are beginning to question the reliability of fingerprint evidence.
This issue was recently addressed by the New Jersey Supreme Court in the case of State v. French Lee. In that case a defendant had been convicted of burglary based solely on latent fingerprint analysis. The fingerprint evidence was admitted without a pretrial hearing, but the defendant appealed, arguing that a hearing should have been held to determine whether the evidence was reliable enough to be admitted.
New Jersey courts have long used what is known as the Frye standard to assess the reliability of fingerprint evidence. Under this standard, any techniques that have generally been accepted by the scientific community can typically be considered to be reliable by criminal courts. A 2023 case updated these standards in New Jersey, requiring evaluations in cases where certain types of evidence had previously been approved, but new scientific developments have led to questions about reliability. Courts may now use what are known as the Daubert factors to evaluate whether certain types of evidence may be admissible.
The Innocence Project, which represented the defendant in the appeal to the New Jersey Supreme Court, argued that the judge in this case should have taken steps to evaluate the reliability of fingerprint evidence before allowing it to be admitted. They highlighted a number of issues with fingerprint evidence that have been highlighted by studies performed in recent years, including:

Whether different examiners may come to different conclusions when evaluating the same evidence

Whether confirmation bias may lead examiners to misidentify suspects

Whether assumptions that everyone has unique fingerprints and that people’s fingerprints do not change over time are true

Significant error rates that have been reported in fingerprint analysis

A lack of uniform standards for identifying suspects based on fingerprints

The tendency of jurors to place too much value on the testimony given by experts
Based on these factors, the Innocence Project argued that reforms need to be made to the practices used when evaluating fingerprint evidence, including implementing strict rules for how fingerprint evidence may be presented in criminal trials and how experts may testify, as well as updates to jury instructions to ensure that jurors fully understand the reasons fingerprint evidence may not be fully reliable.
The New Jersey Supreme Court ordered a hearing to evaluate the fingerprint evidence used in this case and determine whether to impose limitations on the use of fingerprint evidence in the future. While the outcome of this case will specifically affect criminal cases in New Jersey, it may serve as a model for state and federal courts throughout the United States as they determine how fingerprint evidence may be admitted, how it may be considered, and how it may affect the outcomes of criminal cases.
