Risk of Injury to a Minor

The charge of Risk of Injury to a Minor is extremely broad. It is often added as a separate charge to another offense for which you are charged due to its all-encompassing nature.

At any time that your alleged conduct is seen as impairing or endangering the health, welfare, morals, physical or mental safety of a child under the age of 16, you will be charged with Risk of Injury to a Minor.

The mere physical presence of a child under the age of 16 at or near a location at which another crime is alleged to take place, will almost certainly lead to the additional charge of Risk of Injury to a Minor. Therefore, it is possible for individuals to be charged with Risk of Injury to a Minor, even when the alleged crime was not intended against a child. Examples of cases which may lead to an additional charge for Risk of Injury to a Minor include:

  • Domestic disputes when a child is present in the room or the household (or child abuse)
  • Drunk driving when a child is present in the vehicle/drunk driving accident in which a minor is in the vehicle struck
  • Possession of marijuana in the home/vehicle when a minor is present in the home/vehicle
  • Sexual Assault or attempted sexual assault on a minor
  • Any other criminal activity when a minor is present (if it is alleged that the minor's health, welfare, morals or safety are compromised)

  • Internet solicitation of a minor for actual sexual contact and/or gratification
  • Other crimes involving children

Child Pornography

Related possession and/or distribution of child pornography crimes usually occur if an individual is arrested for matters such as Risk of Injury to a Minor, sexual assault, internet solicitation or other crimes involving a minor, in which a computer is seized as potential evidence. When reviewing the evidence, specially trained investigators are capable of recovering material on the computer's hard drive - even when an individual believed that the materials has been completely deleted or erased.

Many companies today also closely monitor their employees' use of company computers. Any misuse or unauthorized use of a computer by an employee can lead not only to termination, but also in many instances, to the reporting of the misuse to law enforcement authorities, which can also lead to an examination of the computer's hard drive and to charges for child pornography or other crimes.
